These Terms govern your use of tradewinleads.com and the services of TradeWin Leads, a service of ConsultingWhiz AI ("we," "us," or "our"). By using the site or our services, you agree to these Terms.
TradeWin Leads provides lead-generation and marketing services for trade businesses, which may include AI call answering, website build and management, local and AI search, advertising, outreach, opportunity discovery, and follow-up. We surface and score public and commercial opportunities. We do not write, prepare, or submit bids or proposals on your behalf.
We work hard to deliver results, but we do not guarantee any specific outcome, number of leads, jobs, contracts, rankings, or revenue. Any figures, examples, or timelines shown on our site are illustrative only. Your results depend on your trade, market, pricing, responsiveness, and many factors outside our control.
Specific fees, scope, and billing are set out in your separate service agreement or order form. Plans are month-to-month unless otherwise agreed, and you may cancel as described there.
You own your domain, your website content, and your customer data. We retain ownership of our own tools, templates, and systems. You grant us the access needed to provide the services.
The services rely on third-party platforms (for example, scheduling, voice AI, advertising, hosting, and search providers). We are not responsible for their availability, pricing, or actions, and your use of them is subject to their terms.
You agree not to misuse the site or services, including by attempting to disrupt them, infringe others' rights, or use them for unlawful purposes.
The site and services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising from the services is limited to the amounts you paid us in the three months before the claim, and we are not liable for indirect, incidental, or consequential damages. You agree to indemnify and hold us harmless from claims arising out of your business, the work you perform, your bids, or your breach of these Terms.
Either party may end the engagement as described in your service agreement. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of [California], without regard to conflict-of-laws rules.
